Now every flat owner in Maharashtra will be given a ‘Vertical Property Card’. This is a new document in which the right of each flat owner to the land on which this multi-storey building stands will be clearly seen. From here, the actual ownership of both the land and the flat will be transparent. Disputes will be reduced, records will be accurate, and transparency will increase. To be honest – such a system must be in every state of the country.
What is a Vertical Property Card?
In the current system, when you buy a flat in a multi-storey building, the land record remains in the name of the builder or society. The names of individual flat owners are not entered in the land records – so it is difficult to prove ownership. ‘Vertical Property Card’ will remove this biggest drawback. This card will become a strong legal evidence along with the sale deed or share certificate.
This card will have two main information:
Total area of land
Rights/share of each flat owner in the building
Let’s understand with a simple example
Suppose there are 100 flats in a building. In the current system, it is not clear who has what share in the land records. Now in the new ‘Vertical Property Card’, the fair and legal share of each flat owner on the land will be clearly written. So, transparency on the issue of ownership – from the land on which the building stands to the common area – everything is clear.
Where is the current system missing?
In cities like Mumbai, people prove their ownership on sale deeds and share certificates. But the land records remain in the name of the builder or the society under the influence of the old law. That is, individual owners do not appear in the government records. If there is a dispute, it takes a long time to prove ownership.
When will this card be available?
A high-level committee formed by the Maharashtra government will give its final report by December 2025. This card will be mandatory for new flats from January 2026. Old flat owners will get it by December 2027.
Which disputes will be resolved?
Whose share of the land — especially at the time of redevelopment — is the most disputed issue. The vertical property card will completely remove this ambiguity. Illegal construction, wrong ownership, document mess — all this will be under control.
